On Tuesday afternoon, Ohio State stole the headlines in the sporting world after news of what the school is attempting to do went viral.
The university filed an application for a trademark for the word “the.” By now, you’ve heard former players and coaches reference their time at “THE” Ohio State University.
Attorney Josh Gerben uncovered the trademark application by OSU, filed on August 8. The school is planning on using the word on the front of shirts, hats and other merchandise.
After the application was made public, Ohio State received plenty of backlash from social media.
Ohio University got in on the fun.
“Good morning from THE first university in the state of Ohio,” the school wrote on a Twitter post.

It’s a bold move from Ohio State, one that faces significant challenges.
“In order for a trademark to be registered for a brand of clothing, the trademark must be used in a trademark fashion,” Gerben said. “In other words, it has to be used on tagging or labeling for the products. In this case, just putting the word ‘the’ on the front of a shirt is not sufficient trademark use.”
We’ll have to wait and see how it plays out.
